Terms & Conditions

The healthcare providers (HCP) using the app will be referred to as “HCP”. The healthcare provider treating the patient presently shall be referred to as “Treating HCP” and the healthcare provider who has reported about the conduct of the patient on this app or website shall be referred to as “Reporting HCP”.   The developer of the application (app) & website will be referred to as “app developer”.

  1. The main objective of the app is to provide best possible medical treatment to the patients. The app developer(s) are law-abiding citizens and strictly discourage any disorder or lawlessness.
  2. No patient’s medical or other personal details will be shared on this platform (app or website).
  3. No patient’s medical or other personal details will be shared amongst HCP without the consent of the patient.
  4. The HCP shall be solely responsible for the information shared regarding the conduct of the patient with other HCP. The HCP is strictly advised NOT to share ANY information with other HCP which is not permissible by law of land, not permissible ethically or not permissible morally. The app developer is neither responsible nor aware of the information shared between two HCP and shall not be liable for the actions of any HCP which are beyond its control. All HCP shall be liable for their own actions. In no event shall the app developer be liable to anyone for any decision made or action taken by any HCP based on such information.
  5. The HCP shall be solely responsible for the authenticity of the information shared by him/her with other HCP. The app developer shall be neither responsible nor aware of the information shared between two HCP and shall not be liable for the actions of any HCP which are beyond its control. All HCP shall be liable for their own actions. In no event shall the app developer be liable to anyone for any decision made or action taken by any HCP based on such information.
  6. The HCP is strongly advised not to blindly believe the information obtained from other HCP. They should use their discretion and use the information obtained from other HCP judiciously and with circumspection. In no event shall the app developer be liable to anyone for any decision made or action taken by any HCP based on such information.
  7. No patient shall be refused emergency treatment by any HCP under ANY circumstances (Rule-2.4: Indian Medical Council- Professional Conduct, Etiquette and Ethics Regulations, 2002 amended on 8th October 2016). The app developer will not be liable for the actions of any HCP refusing emergency treatment to any patient as the same are beyond its control. All HCP shall be liable for their own actions.
  8. No patient shall be refused treatment on the basis of information received on this app or website from any other HCP regarding the conduct of the patient and/or his/her relatives.
  9. The information received on this app from other HCP regarding the conduct of the patient and/or his/her relatives shall be solely for knowing the temperament of the patient and/or his/her relatives and then handling them in judicious optimal manner so that best possible treatment could be provided to the patient. OR (so as to engage with them in a judicious and optimal manner in order to provide the best possible treatment to the patient.)
  10. In case the Treating HCP receives negative feedback about a patient’s conduct from other HCP, the Treating HCP shall administer the treatment to the patient in question as per the prevailing laws of India. Emergency treatment must be given under all circumstances. The app developer shall not be liable for the actions of any HCP refusing emergency treatment to any patient as the same are beyond its control. All healthcare personnel shall be liable for their own actions.
  11. There is NO provision of sharing the details of the conduct of any person on this app or website. Only a broad category of person’s conduct (person’s conduct category) will be marked on this app by the Reporting HCP. The contact of the reporting HCP will be made available to the Treating HCP who intend to get details of the conduct of the person in question.
  12. The Treating HCP who intends to know about the conduct of the person may contact the Reporting HCP from his contact details available on the app or website.
  13. The information obtained from the Reporting HCP shall be kept confidential and not disclosed to anyone. Confidentiality of the information is of utmost importance to the app developer. The app developer shall not be liable for the actions of any HCP, who fail to keep confidentiality of information, as the same are beyond its control. All HCP shall be liable for their own actions.
  14. The name and details of Reporting HCP from whom the information has been obtained shall be kept confidential and not disclosed to anyone (even to the patient or his relatives) by the Treating HCP. This is for strict compliance. The app developer shall not be liable for the actions of any HCP, who fail to keep confidentiality of information, as the same are beyond its control. All HCP shall be liable for their own actions.
  15. The Reporting HCP shall have to take written consent of the patients to share their identifying information (name, mobile number, date of birth, address etc.) on SHEELD app and website.
  16. The app or website is meant to be used only by healthcare personnel (persons engaged in providing healthcare to people)
  17. The user of its (the) SHEELD app are strictly advised not to host, display, upload, modify, publish, transmit, store, update or share any information that,—

                         (i) belongs to another person and to which the user does not have any right;

                        (ii)    is defamatory including, obscene, pornographic, paedophilic, invasive of other’s privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging                                   money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;

                        (iii)      is harmful to child;

                        (iv)      infringes any patent, trademark, copyright or other proprietary rights;

                        (v)       violates any law for the time being in force;

                        (vi)      deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;

                        (vii)     impersonates another person;

                         (viii)    threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any                                               offence or is insulting other nation;

                          (ix)      contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;

                          (x)       is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.
